Court Adjourns Nnamdi Kanu’s Trial Indefinitely

Background

The leader of the proscibed indegeneous people of Biafra (IPOB) Nnamdi Kanu has again cautioned the trial judge, Justice Binta Nyako of the Federal High Court Abuja division, to recuse herself from further hearing on the alleged terrorism charges preferred against him by the federal government.

At the resumed hearing of the case against Mr. Kanu, where he was supposed to file a motion on why Justice Nyako should recuse herself from the case as directed by the Chief Judge, Federal High Court, he became unruly
followimg a September 24, 2024 court order where Justice Binta Nyako recused herself from the case.

But in another development at the hearing today, Nnamdi Kanu’s lead Counsel, Alloy Ejimakor, sought to know why his client was in court, the judge having withdrawn from the case.

Mr. Ejimakor however added that his presence and that of the defence team and its client was to honour the court.

In a reply, Justice Binta Nyako informed them that having withdrawn from the case, she sent the file to the Chief Judge for reassignment to another judge.

However, the files were sent back to her to listen to the motion on Notice and make a ruling thereon.

She therefore called on the defence team to file a formal motion; detailing reasons for its quest for her recusal.

At this point, Nnamdi Kanu directed his lawyers to take the back seat while he rises in his own defence insisting that the Chief Judge does not have the power to force any lawyer on a case and that the Chief Judge can only appeal the court order.

Attempts by his lawyers and even the prosecution counsel to ask for a date for the hearing were interjected by Nnamdi Kanu and vehemently accused Adegboyega Awomolo, SAN, the lead prosecution counsel for the Federal Government of subverting the law.

Justice Binta Nyako consequently adjourned the case indefinitely.
